
Alec Baldwin’s Rust Case Officially Concluded as Prosecutors Drop Appeal
Alec Baldwin’s legal battle over the tragic shooting on the set of Rust has come to an official end. Five months after a New Mexico judge dismissed the involuntary manslaughter charges against the actor, the district attorney’s office has announced that they will not proceed with their appeal.
The incident occurred on October 21, 2021, during the filming of the Western in New Mexico. Baldwin discharged a prop gun containing live ammunition, resulting in the death of cinematographer Halyna Hutchins and injuries to director Joel Souza.
Legal Journey and Resolution
The legal proceedings were fraught with complications. Baldwin was first charged with involuntary manslaughter in January 2023, but those charges were later dropped. A year later, new charges were filed, but the case was dismissed in July 2023 by Judge Mary Marlowe Sommer, who cited a “Brady violation” — the withholding of key evidence by police and prosecutors. The case was dismissed with prejudice, ensuring it could not be refiled.
Despite initially planning to appeal the decision, the prosecutors have now opted to drop their efforts. Mary Carmack-Altwies, attorney for New Mexico’s First Judicial District, acknowledged the outcome in a statement: “Despite its disagreement with the court’s decision, the FJDA remains steadfast in its mission to uphold justice.”

Baldwin’s legal team welcomed the finality of the decision. His attorneys, Luke Nikas and Alex Spiro, described it as “the final vindication” of Baldwin’s position that the incident was a tragedy but not a crime. “The rule of law remains intact in New Mexico,” they said in a statement to Entertainment Weekly.
Other Legal Outcomes
While Baldwin’s case has concluded, Rust armorer Hannah Gutierrez-Reed faced different consequences. In a separate trial, she was convicted of involuntary manslaughter and sentenced to 18 months in prison for her role in the incident.
Baldwin’s Career Resumes
Since the case’s dismissal, Baldwin has returned to his career and public life. He has made appearances on Saturday Night Live, portraying figures like Fox News host Bret Baier and Robert F. Kennedy Jr., and participated in podcasts such as Fail Better With David Duchovny. During a recent interview, Baldwin hinted at further developments related to the Rust shooting, stating, “There’s more to come… My effort is going to be undeniably successful in exposing what really happened.”
Despite the challenges, Baldwin remains optimistic about his career and personal life. “Things are coming back my way to work,” he shared. “I’m happy about that because I’ve got seven kids.”
Looking Ahead: The Baldwins on TLC
One of Baldwin’s upcoming projects will bring a personal touch to the screen. A new reality show titled The Baldwins, focusing on his family life with wife Hilaria Baldwin, is slated to premiere on TLC in 2025.
With the legal chapter closed, Baldwin appears focused on moving forward, both professionally and personally.
